These Terms of Service ("Terms") govern your use of JobSpecCheck's AI-powered job specification auditing platform and services (the "Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and the organization.

Service Description

JobSpecCheck is operated by Helton Labs LLC ("Helton Labs," "we," "our," or "us") and provides AI-powered analysis and optimization of job specifications, including:

• Bias detection and elimination in job postings
• Employment law compliance checking
• Readability and clarity analysis
• Structured data extraction and parsing
• AI-powered content rewriting and optimization
• API access for integration with existing systems

Service Availability

• We aim for 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• Service features may be updated, modified, or discontinued
• We reserve the right to impose usage limits to ensure fair access

Beta Features

Some features may be designated as "beta," "experimental," or "preview." These features are provided "as is" and may not work properly, may be changed or discontinued, and are not covered by any SLA.

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use our Service
• One person or entity may not maintain multiple accounts

Account Responsibilities

• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Keep your account information current and accurate
• Do not share your account credentials with others

Account Termination

You may terminate your account at any time through your account settings. We may suspend or terminate accounts that violate these Terms or for legitimate business reasons with appropriate notice.

Permitted Uses

You may use our Service to:

Prohibited Uses

You may NOT use our Service to:

• Upload malicious code, viruses, or harmful content
• Attempt to reverse engineer, decompile, or extract our algorithms
• Use automated tools to abuse or overload our systems
• Share or resell access to our Service without permission
• Collect or harvest user data from our platform
• Create job postings with intentionally discriminatory content
• Use the Service for competitive analysis of our platform

Your Content

• You retain ownership of job specifications and content you submit
• You grant us a license to process, analyze, and improve your content using our AI
• You are responsible for ensuring you have rights to content you submit
• You must not submit confidential information without proper authorization

Our Platform

• JobSpecCheck and all related IP are owned by us or our licensors
• You receive a limited, non-exclusive license to use our Service
• This license terminates when your account is terminated
• You may not copy, modify, or create derivative works of our platform

AI-Generated Content

• AI-generated suggestions and improvements are provided "as is"
• You are responsible for reviewing and approving any AI-generated content
• We do not claim ownership of AI outputs based on your input
• You should verify compliance and accuracy of AI-generated content

Subscription Plans

• Paid subscriptions are billed monthly or annually in advance
• Prices are stated in USD and subject to applicable taxes
• Plan features and pricing may change with 30 days notice
• Downgrades take effect at the next billing cycle

Payment Processing

• Payments are processed securely through Stripe
• You authorize us to charge your payment method automatically
• Failed payments may result in service suspension
• You are responsible for keeping payment information current

Refunds and Cancellations

• You can cancel your subscription at any time
• Cancellations are effective at the end of the current billing period
• No refunds are provided for partial billing periods
• Starter and Enterprise plans are billed monthly

Enterprise Customers

Enterprise customers with custom agreements may have different payment terms as specified in their separate agreement.

Data Processing

• We process your data as described in our Privacy Policy
• Job content is analyzed by AI systems and then deleted or anonymized
• We implement industry-standard security measures
• Data is encrypted in transit and at rest

Third-Party Services

• We use OpenAI for AI processing (subject to their terms)
• Payment processing is handled by Stripe
• Analytics and monitoring services may process usage data
• We maintain data processing agreements with all processors

Data Portability and Deletion

• You can export your account data at any time
• Account deletion removes personal data within 90 days
• Some data may be retained for legal compliance
• Anonymized analytics data may be retained indefinitely

AI Analysis Limitations

• AI suggestions are not guaranteed to be accurate or complete
• Legal compliance varies by jurisdiction and context
• Human review and judgment are always recommended
• AI models may have biases or limitations

Service "As Is"

• The Service is provided "as is" without warranties
• We disclaim all warranties, express or implied
• We do not guarantee uninterrupted or error-free service
• Results may vary based on input quality and context

Liability Exclusions

We are not liable for:

• Indirect, incidental, or consequential damages
• Lost profits, data, or business opportunities
• Third-party claims based on AI suggestions
• Employment law violations in your job postings
• Hiring decisions made based on our analysis

Damage Cap

Our total liability to you for all claims will not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

Termination by You

• You may terminate your account at any time
• Cancellation is effective at the end of your billing period
• You remain responsible for charges incurred before termination
• You can export your data before termination

Termination by Us

We may terminate or suspend your account if:

• You violate these Terms or our Acceptable Use Policy
• Your payment fails and you don't update payment information
• We discontinue the Service with reasonable notice
• Required by law or legal process

Effect of Termination

• Your right to use the Service ends immediately
• We will delete your account data as described in our Privacy Policy
• Provisions regarding liability and disputes survive termination
• Outstanding payment obligations remain due

Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles. The exclusive venue for disputes shall be the state and federal courts located in Georgia.

Changes to Terms
